Participating in the Christmas competition of DataStore AG, hereinafter referred to as the Operator or Organizer, is free of charge and is exclusively based on these terms of participation.
Competition procedure details
The competition will last from 27 November to 31 December 2023. Within this period, users have the option of participating in the competition online.
Participation
Participating in the competition is free of charge. Users must fill in and send the participation form shown to participate in the competition. Users can only participate during the participation period. Submissions received after the participation deadline will not be taken into account in the draw.
Eligible participants
Eligible participants are natural persons who reside in Switzerland and are 18 years of age or above. If a participant has limited legal capacity, they require the consent of their lawful representative.
People not eligible to participate in the competition are all those people involved in the conception and realization of the competition and employees of the Operator and their family members. The Operator also reserves the right to exclude people from participating at its own discretion if there are legitimate reasons for this, for example
(a) in the event of any form of manipulation in connection with access to or implementation of the competition, (b) in the event of breaches of these terms of participation, (c) in the event of unfair actions or (d) in the event of incorrect or misleading information in connection with participation in the competition.
Prize, notification and transfer of the prize
This competition’s prize consists of multiple individual services to be provided to the winners as part of the competition between 3 and 24 December 2023. Each person can only win one prize per calendar week, in particular per Advent Sunday.
The winners will be determined after the participation deadline at the end of the calendar week on the occasion of the Advent Sunday. The competition is linked to a task and only the participants who correctly complete the task will be included in the draw.
The winners of the draw will be informed promptly via a separate email about the prize.
The prize will only be handed out to the winner. An exchange or cash payment of the prize is not possible.
The Operator accepts any costs incurred for shipping the prizes. The winner will bear any additional costs associated with claiming the prize. The winner themselves is responsible for any taxation applied to the prize.
If the winner does not respond within a period of three weeks after being asked twice, the prize can be transferred to another participant.
Ending of the competition
The Organizer expressly reserves the right to end the competition without prior notice and without providing any reasons. This applies in particular to any reasons that would interfere with or prevent the competition from running as planned.
Data protection
Personal data must be provided to participate in the competition. The participant ensures that the personal information they provide, in particular first name, last name and email address, are true and correct.
The Organizer points out that none of the participant’s personal data shall be disclosed to third parties or made available for use without their consent. The partners of this competition are exceptions to this, in particular the manufacturers Dell Technologies, Barracuda, Cynet and Vectra. The participants in the competition agree that their data can be collected, stored and disclosed to the specified manufacturers for the purposes of carrying out the competition and for marketing purposes such as communication and lead management.
If they win, the winner agrees to the publication of their name and town/city of residence in the advertising material used by the Organizer. This includes announcement of the winner on the Organizer’s website and its social media platforms.
The participant can withdraw their declared consent at any time. The withdrawal must be sent in writing to the Organizer’s contact details specified in the legal notice area on the competition landing page. After withdrawal of consent, the participant’s collected and stored personal data will be erased right away. The withdrawal of consent does not affect the lawfulness of the processing which took place based on the consent up until it was withdrawn.
